Two get prison in cosmetic surgery death in Las Vegas - USA Today
LAS VEGAS ? A Colombian husband and wife were each sentenced Thursday to up to eight years in a Nevada prison plus a year in county jail for leaving a Las Vegas mother of three to die after botching her buttocks enhancement procedure in a back room of a Las Vegas tile store.
Ruben Matallana-Galvas, 56, and Carmen Torres-Sanchez, 47, apologized to the dead woman's family and asked the judge for leniency.
"It was not my intention to cause her death," Matallana-Galvas said through a Spanish-language court interpreter. "We have reflected, and we have seen that it was a mistake. I accept 100 percent responsibility. But we are not bad people. We have helped the health and welfare of a lot of people."
But Clark County District Court Judge Abbi Silver gave each the maximum: three years and two months to eight years in state prison, a year in the Clark County jail in Las Vegas and a $12,000 fine.
Matallana-Galvas and Torres-Sanchez pleaded guilty in August to felony involuntary manslaughter and conspiracy, and to misdemeanor practicing medicine without a license.
"A real doctor, sir, would not leave a dying woman out to die a horrible and painful death while you, sir, fled the scene of the crime in an effort to save yourself," Silver told Matallana-Galvas. "You chose to let this woman die."
Matallana-Galvas said he was a homeopathic physician in Colombia. Torres-Sanchez was a lawyer with the country's attorney general's office. Authorities said they were in the U.S. on tourist visas.
Prosecutor Marc DiGiacomo characterized Matallana-Galvas and Torres-Sanchez, as greedy con artists who preyed on Hispanic patients for money.
An autopsy showed Elena Caro, 42, died April 9 from an allergic reaction to anesthesia administered before an injection of a gel to reshape her buttocks. Caro had received facial injections from Matallana-Galvas a week earlier, with no side effects.
Authorities said the fateful procedure on Cano took place in a back room of a Tiles and More store east of downtown Las Vegas.
Matallana-Galvas admitted Thursday that he was conducting the procedure and Torres-Sanchez was assisting when Caro became ill.
DiGiacomo said they bundled Caro into a car with another woman, but Caro died on the way to a hospital. Police said Caro was found on a street not far from North Vista Hospital in Las Vegas.
"Why didn't they help her?" Caro's 17-year-old daughter, Janet Villalobos, asked as she read a statement in court. "Why didn't they call an ambulance when they realized something was wrong? Instead, they tried to escape."
Police arrested Matallana-Galvas and Torres-Sanchez hours later at McCarran International Airport as they prepared to board a flight for Colombia.
In court Thursday, the judge dismissed their emotional pleas for forgiveness and leniency and rebuked Torres-Sanchez.
Her defense lawyer asked Silver to consider Torres-Sanchez's work for more than two decades as a prosecutor and corruption-fighter for the attorney general in Colombia.
"Talk about corrupt. Where do you begin in this case?" Silver said. "You and your husband set up this shop in the back of this tile store. You assisted him in practicing medicine without a license. All for money.
"What you did was morally and legally corrupt," the judge told Torres-Sanchez. "You, of all people, know better."
Villalobos said outside court she was glad the couple received the maximum sentence.
Her aunt, Maria Caro, 32, told the judge the family knew the sentence wouldn't return Caro to her family.
"But it will give some closure to her father, her daughter and her two boys," she said.
Under terms of their plea agreement, Matallana-Galvas and Torres-Sanchez cannot appeal their convictions or sentences. Their visas have expired, and they will face deportation following their prison terms.

BALTIMORE, Oct. 6, 2011 /PRNewswire/ -- Women get the lion's share (87 percent) of all the surgical and non-invasive cosmetic procedures in the United States. That's why most plastic surgery advertising is still directed toward them.
Plastic surgery for men, however, is on the rise. According to the American Society of Plastic Surgeons, male cosmetic procedures were up 2 percent last year. Statistically, men preferred surgical solutions rather than repeated non-surgical treatments, which bucks the national trend. So although more men are undergoing non-invasive procedures, the number of surgical procedures for men are growing at a faster pace.
Male facelifts increased by 14 percent from 2009 to 2010, the fastest-growing procedure. Male rhinoplasty (nose reshaping surgery) is still the surgical procedure done most often. Both procedures, one could say, are the surgical equivalents of a man entering a barber shop and saying, "Take a little off the top." In other words, men want to look better, but not drastically different.
These trends highlight the primary difference between what women want and what men want from cosmetic surgery. The most popular surgical procedure for women (breast augmentation) helps women gain self-esteem by addition. Men, on the other hand, tend to favor more subtle procedures that erase their perceived faults, thus gaining self-esteem through subtraction.
Facelifts, rhinoplasty, otoplasty (ear surgery), and liposuction - all popular plastic surgery procedures for men - remove either wrinkles, bumps, or fat from the male body. SALT LAKE CITY -- In 2007, Forbes magazine published an article saying that Salt Lake City was the ?vainest? city in America, thanks in large part to its relatively high number of plastic surgeons, six per 100,000 people. Statewide, the numbers are only a little behind that; Utah came in at No. 8 in 2010 for the number of board-certified plastic surgeons per capita, according to an article on ksl.com.
The question remains, however, is this statistic a fair assessment of the state?s ?vanity?? Who, exactly, is having what done when it comes to cosmetic surgery in Utah? What does all this information say about Utah residents? willingness to go under the knife?
Nationally, cosmetic surgery is on the rise
According to 2010 statistics provided by the American Society of Plastic Surgeons (ASPS), both surgical and minimally invasive cosmetic procedures are on the rise. The total number of cosmetic procedures performed in 2010 was 13.1 million, which is an increase of 5 percent over the previous year. Reconstructive surgeries also rose slightly; more than 5.3 million reconstructive procedures were performed, which is an increase of 2 percent.
The ASPS is the largest plastic surgery specialty organization in the world, and its members consist of board-certified plastic surgeons. While patients are encouraged to seek out physicians who are certified by the ASPS or American Society for Aesthetic Plastic Surgery, medical professionals are not legally required to be a member of either society or have much specialty training in plastic surgery in order to perform cosmetic procedures. The true number of cosmetic procedures being performed, then, may actually be slightly higher.
Most popular procedures by numbers
Despite the economic downturn, minimally invasive procedures remain incredibly popular, perhaps owing their success to their relative affordability. According to the ASPS, Botox and Dysport injections are both up by 12 percent and fat injections are up by 14 percent, which indicate how a patient?s own tissue is being used in creative ways to rejuvenate the body. There were 11.6 million minimally invasive procedures reported in 2010, with the top five as follows:
- Botulinum toxin type A (Botox)
- Soft tissue fillers
- Chemical peel
- Laser hair removal
- Microdermabrasion
- Breast augmentation
- Nose reshaping
- Eyelid surgery
- Liposuction
- Tummy tuck
A real indication of the change in the way that cosmetic surgery is viewed now as opposed to 10 years ago is the rising prevalence of younger and younger women going in for the ?mommy makeover?: varying combinations of body sculpting procedures such as tummy tucks, breast lifts, breast augmentations and liposuction. A recent survey conducted by the ASPS showed that 62 percent of women would consider getting a mommy makeover if cost were no issue.
The numbers of women getting these procedures is up dramatically since 2000. Breast augmentations have risen by 39 percent; breast lifts, 70 percent; and tummy tucks, a dramatic 85 percent in 10 years. The ASPS also points out that women as young as 30 are often going in for these procedures to get their pre-baby bodies back, where 10 years ago, it was mostly women 50 and older.
This trend is interesting for Utah?s population, in particular, because of the high percentage of young mothers and birthrates in the state. Utah?s plastic surgeons indicate that a large number of the women they see are requesting these procedures in particular.
As Cathy Carmode Lim noted in her article on ksl.com where image- conscious Californians may go in for a breast augmentation in San Diego simply to increase bust size, Utah women are more likely to go under the knife for body ?restoring? purposes. That is, they don?t want to come out with a dramatically different body after plastic surgery, they just want to look the way they did before age and pregnancy took their toll.
Are Utah residents vain?
Most likely would agree that spending anywhere from $5,000 to $15,000 to get rid of a mommy muffin top may indicate that Utahans are not as vanity-free as they would like to believe.
There are other factors to consider, however, when analyzing the surgeon-to-population ratio in the Beehive State. First, there?s the University of Utah. Not all (or even most) urban areas are home to a world-class residency program in plastic surgery. Many of the physicians who train here go on to open practices in the state.
Another factor could be the relative cost of procedures in Utah versus surrounding states. Some patients may choose to come to Utah rather than spend thousands more to have the same surgeries done closer to home.
Still, there wouldn?t be the number of plastic surgeons that there is in Utah without the necessary patient demand to keep them in business. As some Utah plastic surgeons pointed out to Carmode Lim, the tight-knit community may actually help increase word-of-mouth exposure.
Whether all of this is an accurate gauge to measure the relative vanity of Utah residents compared to other states is a little dubious, however. What is clear is that Utah residents in general certainly seem to be OK with having a little work done.

After new VAT guidelines were introduced the cost of cosmetic surgery will rise by 20% in the United Kingdom. Surgeons who carry out plastic surgery purely for cosmetic reasons will need to register for VAT (Value Added Tax) and add that amount onto the patient's bill.
VAT is similar to the US Sales Tax.
According to HMRC (HM Revenue and Customs), this is not a new law, but rather a clarification regarding existing laws, and that relevant trade professionals have received the new guidance.
Those in the cosmetics industry, who are calling this "The boob tax", say this move should mean an additional �500 million ($780 million) in government revenue. The UK government, like many others in Europe, is forever seeking out ways of reducing its deficit.
To date, VAT has been added only onto Botox injections, chemical peels and other minor treatments performed in beauty salons.
A breast enhancement operation will rise by approximately �1,000 ($1,600).
If the cosmetic procedure is for therapeutic reasons, the VAT can be exempt, UK authorities said.
UK authorities wrote:
". . . cosmetic services which are performed mainly for beautification or rejuvenation purposes, or done out of the individual's free choice rather than out of medical necessity, are liable to VAT at the standard rate. Such services may include: face lifts, tummy tucks, female breast enlargement, liposuction, hair and tattoo removal using lasers and intense pulse light source machines."
The guidance adds that people will not be eligible for exemption from VAT if the sole aim of the surgery is to make the individual feel better about themselves.
British Association of Aesthetic Plastic Surgeons (BAAPS) president, Fazel Fatah, said:
"The subjective proposals being put forward by HMRC will potentially harm large numbers of patients. They imply that, by definition, any procedure that corrects appearance rather than function is not a medical need. There has been no meaningful discussion with the professional bodies involved.We can only hope that common ground can be found that protects the wellbeing of patients while balancing the obvious need to increase tax revenues. With surgery, we are dealing with human lives."
UK plastic surgeons are already commenting on the difficulty, in some cases, in determining whether a plastic surgical procedure can be classed as therapeutic. If a woman's breasts are not symmetrical, at what severity of asymmetry would they be exempt from VAT? What about the correction of prominent ears? In the UK the National Health Service (NHS) covers the cost for children so that they won't be bullied or teased at school.

Plastic surgery is divided into two parts:- Cosmetic surgery - in this case the appearance was basically normal to start with. For example, a 60-year-old patient may want a face lift to look younger. Before the procedure, his/her face looked basically normal.
- Reconstructive surgery - the body parts are not within the range of normal appearance before surgery - the surgeon's aim is to make it look more normal. Examples include repairing a cleft lip, fixing a nose that has been broken, or reshaping breasts after breast cancer surgery.

This is a technically complex part of VAT governed ultimately by European law, which domestic law then implements in the UK. So it is not as simple as HMRC just being free to change what it wants.
Instead the problem is interpreting and applying European law. This makes medical procedures, by registered professionals, exempt or VAT free. But a lot depends on the purpose of the procedure, so not everything done by a medical professional is automatically exempt. Likewise not all elective surgery is automatically taxable.
Some people criticise plastic surgery as frivolous and not really medically essential, but this is often based on a subjective opinion. But to the patients the medical benefits, psychological and physical, are objectively very real.
This could raise all sorts of practical and ethical problems. What to do if the VAT status, and hence cost, of a medical procedure had to be decided by whether HMRC claimed the procedure a taxable luxury while the patient considered it vital ?

PHILLIP ISLAND, Australia, Oct 16 (Reuters) - Former MotoGP champion Jorge Lorenzo was rushed to a Melbourne hospital for emergency plastic surgery on Sunday after one of his fingers was severely injured in a crash during morning practice.
The sickening injury to the Spaniard?s finger on his left hand forced him to miss the race and ultimately concede the championship to Australian Casey Stoner, who won his fifth straight home grand prix at Phillip Island.
Lorenzo crashed at the exit of turn 12 on his final lap of the 20-minute session, high-siding off the bike and coming to rest on the edge of the circuit.
He walked away from the site shaking his hand and was ruled unfit to start the race by the circuit?s medical centre.
?When I saw Jorge?s crash I thought it was just a small crash,? Stoner told reporters after his victory.
?I thought it might be just a small graze or something like that.
?Then I saw the replay and saw what actually happened and everyone was out there looking for the end of his finger.
?And it sort of made me feel a little bit sick because I?m a racer, I know what it?s like to go through these things and you can?t really wish them upon anyone.?
A team spokesman said later that Lorenzo had not lost part of his finger in the crash, but that the top of his finger was badly injured and the full extend of the injury would not be disclosed until after the surgery on Sunday night.
?He is currently undergoing surgery ? We will release a statement once we have a full medical report,? he said.
The injury put paid to Lorenzo?s slim hopes of staying in the championship hunt as Stoner took an unassailable lead over the Spaniard with two races left in the championship.
It was a grim day all round for Yamaha who were also forced to scratch Ben Spies, while British rider Cal Crutchlow also retired after slipping in the wet late in the race.

Cosmetic surgery: Is Utah still the vainest? - ksl.com
SALT LAKE CITY -- In 2007, Forbes magazine published an article saying that Salt Lake City was the ?vainest? city in America, thanks in large part to its relatively high number of plastic surgeons, six per 100,000 people. Statewide, the numbers are only a little behind that; Utah came in at No. 8 in 2010 for the number of board-certified plastic surgeons per capita, according to an article on ksl.com.
The question remains, however, is this statistic a fair assessment of the state?s ?vanity?? Who, exactly, is having what done when it comes to cosmetic surgery in Utah? What does all this information say about Utah residents? willingness to go under the knife?
Nationally, cosmetic surgery is on the rise
According to 2010 statistics provided by the American Society of Plastic Surgeons (ASPS), both surgical and minimally invasive cosmetic procedures are on the rise. The total number of cosmetic procedures performed in 2010 was 13.1 million, which is an increase of 5 percent over the previous year. Reconstructive surgeries also rose slightly; more than 5.3 million reconstructive procedures were performed, which is an increase of 2 percent.
The ASPS is the largest plastic surgery specialty organization in the world, and its members consist of board-certified plastic surgeons. While patients are encouraged to seek out physicians who are certified by the ASPS or American Society for Aesthetic Plastic Surgery, medical professionals are not legally required to be a member of either society or have much specialty training in plastic surgery in order to perform cosmetic procedures. The true number of cosmetic procedures being performed, then, may actually be slightly higher.
Most popular procedures by numbers
Despite the economic downturn, minimally invasive procedures remain incredibly popular, perhaps owing their success to their relative affordability. According to the ASPS, Botox and Dysport injections are both up by 12 percent and fat injections are up by 14 percent, which indicate how a patient?s own tissue is being used in creative ways to rejuvenate the body. There were 11.6 million minimally invasive procedures reported in 2010, with the top five as follows:
- Botulinum toxin type A (Botox)
- Soft tissue fillers
- Chemical peel
- Laser hair removal
- Microdermabrasion
- Breast augmentation
- Nose reshaping
- Eyelid surgery
- Liposuction
- Tummy tuck
A real indication of the change in the way that cosmetic surgery is viewed now as opposed to 10 years ago is the rising prevalence of younger and younger women going in for the ?mommy makeover?: varying combinations of body sculpting procedures such as tummy tucks, breast lifts, breast augmentations and liposuction. A recent survey conducted by the ASPS showed that 62 percent of women would consider getting a mommy makeover if cost were no issue.
The numbers of women getting these procedures is up dramatically since 2000. Breast augmentations have risen by 39 percent; breast lifts, 70 percent; and tummy tucks, a dramatic 85 percent in 10 years. The ASPS also points out that women as young as 30 are often going in for these procedures to get their pre-baby bodies back, where 10 years ago, it was mostly women 50 and older.
This trend is interesting for Utah?s population, in particular, because of the high percentage of young mothers and birthrates in the state. Utah?s plastic surgeons indicate that a large number of the women they see are requesting these procedures in particular.
As Cathy Carmode Lim noted in her article on ksl.com where image- conscious Californians may go in for a breast augmentation in San Diego simply to increase bust size, Utah women are more likely to go under the knife for body ?restoring? purposes. That is, they don?t want to come out with a dramatically different body after plastic surgery, they just want to look the way they did before age and pregnancy took their toll.
Are Utah residents vain?
Most likely would agree that spending anywhere from $5,000 to $15,000 to get rid of a mommy muffin top may indicate that Utahans are not as vanity-free as they would like to believe.
There are other factors to consider, however, when analyzing the surgeon-to-population ratio in the Beehive State. First, there?s the University of Utah. Not all (or even most) urban areas are home to a world-class residency program in plastic surgery. Many of the physicians who train here go on to open practices in the state.
Another factor could be the relative cost of procedures in Utah versus surrounding states. Some patients may choose to come to Utah rather than spend thousands more to have the same surgeries done closer to home.
Still, there wouldn?t be the number of plastic surgeons that there is in Utah without the necessary patient demand to keep them in business. As some Utah plastic surgeons pointed out to Carmode Lim, the tight-knit community may actually help increase word-of-mouth exposure.
Whether all of this is an accurate gauge to measure the relative vanity of Utah residents compared to other states is a little dubious, however. What is clear is that Utah residents in general certainly seem to be OK with having a little work done.

Motorcycling-Lorenzo rushed for plastic surgery on injured finger - YAHOO!

PHILLIP ISLAND, Australia, Oct 16 (Reuters) - Former MotoGP champion Jorge Lorenzo was rushed to a Melbourne hospital for emergency plastic surgery on Sunday after one of his fingers was severely injured in a crash during morning practice.
The sickening injury to the Spaniard?s finger on his left hand forced him to miss the race and ultimately concede the championship to Australian Casey Stoner, who won his fifth straight home grand prix at Phillip Island.
Lorenzo crashed at the exit of turn 12 on his final lap of the 20-minute session, high-siding off the bike and coming to rest on the edge of the circuit.
He walked away from the site shaking his hand and was ruled unfit to start the race by the circuit?s medical centre.
?When I saw Jorge?s crash I thought it was just a small crash,? Stoner told reporters after his victory.
?I thought it might be just a small graze or something like that.
?Then I saw the replay and saw what actually happened and everyone was out there looking for the end of his finger.
?And it sort of made me feel a little bit sick because I?m a racer, I know what it?s like to go through these things and you can?t really wish them upon anyone.?
A team spokesman said later that Lorenzo had not lost part of his finger in the crash, but that the top of his finger was badly injured and the full extend of the injury would not be disclosed until after the surgery on Sunday night.
?He is currently undergoing surgery ? We will release a statement once we have a full medical report,? he said.
The injury put paid to Lorenzo?s slim hopes of staying in the championship hunt as Stoner took an unassailable lead over the Spaniard with two races left in the championship.
It was a grim day all round for Yamaha who were also forced to scratch Ben Spies, while British rider Cal Crutchlow also retired after slipping in the wet late in the race.
The American Spies had qualified seventh despite receiving a knock to the head during a high-speed crash in the session, but was also ruled unfit to race. (Editing by Peter Rutherford/Alastair Himmer)

LAS VEGAS (AP) ? A Colombian husband and wife were each sentenced Thursday to up to eight years in a Nevada prison plus a year in county jail for leaving a Las Vegas mother of three to die after botching her buttocks enhancement procedure in a back room of a Las Vegas tile store.
Ruben Matallana-Galvas, 56, and Carmen Torres-Sanchez, 47, apologized to the dead woman's family and asked the judge for leniency.
"It was not my intention to cause her death," Matallana-Galvas said through a Spanish-language court interpreter. "We have reflected, and we have seen that it was a mistake. I accept 100 percent responsibility. But we are not bad people. We have helped the health and welfare of a lot of people."
But Clark County District Court Judge Abbi Silver gave each the maximum: three years and two months to eight years in state prison, a year in the Clark County jail in Las Vegas and a $12,000 fine.
Matallana-Galvas and Torres-Sanchez pleaded guilty in August to felony involuntary manslaughter and conspiracy, and to misdemeanor practicing medicine without a license.
"A real doctor, sir, would not leave a dying woman out to die a horrible and painful death while you, sir, fled the scene of the crime in an effort to save yourself," Silver told Matallana-Galvas. "You chose to let this woman die."
Matallana-Galvas said he was a homeopathic physician in Colombia. Torres-Sanchez was a lawyer with the country's attorney general's office. Authorities said they were in the U.S. on tourist visas.
Prosecutor Marc DiGiacomo characterized Matallana-Galvas and Torres-Sanchez, as greedy con artists who preyed on Hispanic patients for money.
An autopsy showed Elena Caro, 42, died April 9 from an allergic reaction to anesthesia administered before an injection of a gel to reshape her buttocks. Caro had received facial injections from Matallana-Galvas a week earlier, with no side effects.
Authorities said the fateful procedure on Cano took place in a back room of a Tiles and More store east of downtown Las Vegas.
Matallana-Galvas admitted Thursday that he was conducting the procedure and Torres-Sanchez was assisting when Caro became ill.
DiGiacomo said they bundled Caro into a car with another woman, but Caro died on the way to a hospital. Police said Caro was found on a street not far from North Vista Hospital in Las Vegas.
"Why didn't they help her?" Caro's 17-year-old daughter, Janet Villalobos, asked as she read a statement in court. "Why didn't they call an ambulance when they realized something was wrong? Instead, they tried to escape."
Police arrested Matallana-Galvas and Torres-Sanchez hours later at McCarran International Airport as they prepared to board a flight for Colombia.
In court Thursday, the judge dismissed their emotional pleas for forgiveness and leniency and rebuked Torres-Sanchez.
Her defense lawyer asked Silver to consider Torres-Sanchez's work for more than two decades as a prosecutor and corruption-fighter for the attorney general in Colombia.
"Talk about corrupt. Where do you begin in this case?" Silver said. "You and your husband set up this shop in the back of this tile store. You assisted him in practicing medicine without a license. All for money.
"What you did was morally and legally corrupt," the judge told Torres-Sanchez. "You, of all people, know better."
Villalobos said outside court she was glad the couple received the maximum sentence.
Her aunt, Maria Caro, 32, told the judge the family knew the sentence wouldn't return Caro to her family.
"But it will give some closure to her father, her daughter and her two boys," she said.
Under terms of their plea agreement, Matallana-Galvas and Torres-Sanchez cannot appeal their convictions or sentences. Their visas have expired, and they will face deportation following their prison terms.
